Agreement to Terms

By accessing or using the website mariacooperdesign.com (the "Site") operated by Maria Cooper Design ("Maria Cooper Design," "MCD," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Site.

Services Description

Maria Cooper Design is a boutique design consulting firm offering hospitality and interior design, architectural and commercial design, fire and life safety consulting, and residential design services. The Site provides information about our services, our portfolio, and contact information. Specific design engagements are governed by separate signed agreements between Maria Cooper Design and the client.

Not a Licensed Architecture or Engineering Firm

Maria Cooper Design is a design consulting firm and is not a licensed architecture or engineering firm. For projects requiring signed and sealed construction documents, permitted work, or other services that require a licensed professional under applicable law, MCD engages and coordinates licensed architects, engineers, and other specialists on the client's behalf, under separate engagement terms. Nothing on this Site or in any communication from MCD shall be construed as the practice of architecture, engineering, or any other licensed profession.

Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site
• Use any automated means, including robots, crawlers, or scrapers, to access the Site for any purpose without our express written permission
• Introduce any viruses, Trojan horses, worms, or other material that is malicious or technologically harmful
• Impersonate or attempt to impersonate Maria Cooper Design, Maria Cooper personally, or any other person or entity

Intellectual Property

The Site and its entire contents, features, and functionality — including all information, software, text, displays, images, photographs, renderings, drawings, and design — are owned by Maria Cooper Design, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Portfolio images may include work delivered with or for third-party firms (including but not limited to Telesco Associates, R.D. Hale Inc., and Studio 416). Credit lines on individual project listings indicate the firms with which Maria has collaborated. Use of any image, drawing, or text from this Site without written permission is prohibited.

No Professional Advice

The information provided on the Site is for general informational purposes only. Nothing on the Site constitutes professional architectural, engineering, code, legal, or financial advice. Design and consulting services are provided solely under the terms of a signed engagement agreement. You should consult with qualified, licensed professionals before making decisions about construction, permitting, or code compliance based on information found on this Site.

Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Neither Maria Cooper Design nor any person associated with Maria Cooper Design makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the Site.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Maria Cooper Design, its affiliates, officers, directors, employees, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the Site
• Any conduct or content of any third party on the Site
• Any content obtained from the Site
• Unauthorized access, use, or alteration of your transmissions or content

Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by Maria Cooper Design, including Calendly (consultation scheduling), Formspree or a comparable form-processing provider, Cloudflare (hosting and content delivery), Maria Cooper Art (mariacooperart.com), Maria Cooper Finds (mariacooperfinds.com), and our design-build partner Grainger Cooper Construction. Maria Cooper Design has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Indemnification

You agree to defend, indemnify, and hold harmless Maria Cooper Design and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the courts of the State of Georgia located in Cobb County or the United States District Court for the Northern District of Georgia.

Changes to Terms

We reserve the right to modify these Terms at any time. All changes are effective immediately when posted on the Site. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

SMS / Text Messaging Consent & Terms

By providing your mobile phone number and opting in to receive text messages from Maria Cooper Design, you expressly consent to receive recurring SMS/text messages from us. These messages may include, but are not limited to, consultation reminders, project communications, milestone updates, invoicing notifications, and general business correspondence.

You understand and agree that:

• Consent to receive text messages is not required as a condition of engaging Maria Cooper Design for design services
• Message frequency varies based on your engagement with our services
• Standard message and data rates may apply, as determined by your mobile carrier
• You may opt out at any time by replying STOP to any message
• You may request help by replying HELP or by emailing support@mariacooperdesign.com
• Neither Maria Cooper Design nor mobile carriers are liable for delayed or undelivered messages
• Your mobile information will not be shared with third parties for promotional purposes

Severability
